In this global era, the Fashion Industry is one field in India where one can see continuous growth and where the designers are keeping them akin with the global developments. According to the study conducted by the Associated Chambers of Commerce and Industry of India (ASSOCHAM), in India the domestic designer apparel industry, has reported a compounded annual growth rate of about 40%, and the industry which was worth Rs. 720 crores in 2012, is likely to cross value of Rs. 11,000 crore mark by 2020. In the fashion industry, it is not only the designs but also to the technology which is used to produce such designs on the apparel or used to manufacture various garment which have special qualities. Hence, it is important to protect such products or process in order to ensure that no one produces such a product or uses such a process to produce products with authorization or consent. This is where Patent Law plays a key role in protecting the rights and in India the Patent Act of 1970 and the Patent (Amendment) Act of 2005 are the legislations which deals with the registration of the patents including their protection. Patent is used to protect products or processes that have certain technological advancement as compared with the existing art. Therefore, while considering the Fashion Industry, patent is not the first thing that would come in mind, however, technology or the process used in respect of apparel can be patented. It acts as the best way to commercialize an invention and to prevent others from using the same to create similar goods.
The involvement of technology with fashion has become a common trend nowadays. American designer Lauren Scott has started adding Radio Frequency Chips in her children clothing which would carry medical information that can be helpful in cases of emergencies like accidents and can also have a feature of triggering alarms in case a child breaches a perimeter limits like a house and help prevent kidnapping. The most famous Patent in the Fashion Industry is by the Biotech Company Novozymes, wherein the invention was based on the enzyme called cellulose, which was used to treat Demin jeans to remove indigo dye from denim to give it a worn out look. This technology is widely used all over the world under a license from Novoymes.
Another noteworthy invention in the field of fashion was by an Italian Company, Frindi Srl. who created a fabric made from cock, which is said to be light as silk, smooth as velvet, waterproof, stain proof, and fireproof. Therefore, in some cases patent can be proved to be an integral aspect in the commercialization of the fashion brand and business need to take reasonable steps ensure that their Intellectual Property (IP) is effectively protected.
