In order to ease the conduct of the business the world is relying heavily on technology which ranges from mobile applications to computer software’s where in the last decade innovation and technology have assumed a big role. Artificial Intelligence is one such innovation which has impacted the functional ecosystem of the society as “Artificial Intelligence” can be well defined as the capability of a machine to imitate human behavior. Even in the legal sector lawyers are turning towards Artificial Intelligence expertise for handling legal tools efficiently and for structuring legal assertions and gradually Artificial Intelligence is becoming the need of the hour which has been efficiently put to practice and usage in several western countries and is now knocking the doors of the Indian legal system.

It is important to understand the scope and usage of Artificial Intelligence in the legal sector with its potential benefits. No wonder the legal sector is opting for changes in its day to day activities such as for client management, data entry, data management and other repetitive time-consuming tasks and thus the need for the Artificial Intelligence (AI) comes into picture. The machine learning ability software’s such as Torch, Wenka, SCIKIT-Learn etc are some of the Artificial Intelligence based systems that help in analyzing thousands of complex legal documentation while sorting the relevant document. These systems save are helpful in conducting due diligence, reviewing contracts and risk assessment and assist in many other analysis and assessments. Further, even for conducting legal research “Ross” an Artificial Intelligence system powered by IBM Watson helps in conducting legal research, case brief analysis, summarization of cases, tracking any legal development with respect to user’s legal subject and is also capable of answering legal questions vis a vis rendering expert legal advice. There is also a large potential for the application of Artificial Intelligence in cross border contract drafting, negotiation, and decision-making exercises undertaken by law firms which eventually shall make Artificial Intelligence the sole basis for obtaining legal assistance. Ultimately, Artificial Intelligence is already putting an impact in the western countries in their retail legal market drastically, by providing bigger reach at low costs, which in turn would significantly provide better access to justice issues and benefit millions of individuals including litigants. Time has come when the litigant or the querist need to deploy a plethora of his/her resources to obtain legal advice and assistance. Further, it has become easier for the law firms to intelligently and quickly asses the data, process the query and deliver the desired results. Thus, we can say that Artificial Intelligence (AI) is a better option for Corporations, Lawyers and Law Firms to cater to the needs of their clients in a more systematic manner while using human error free technologies.

In India, the Ministry of Industry and Commerce had constituted an 18 member task force compromising of experts, academics, researchers along with government bodies such as NITI Aayog, the Ministry of Electronics and Technology, the Department of Science and Technology and the Defense Research and Development Organization, titled “Task Force on Artificial Intelligence (AI) for India’s Economic Transformation”. The task force published its report with regard to the formulation of a detailed policy on Artificial Intelligence in India having some of the key takeaways from reports are:
• Identification of ten domains that are relevant to India from the perspective of the development of Artificial Intelligence based technology, such as manufacturing, fin-tech, health, agriculture, national security, environment, public utility services, education etc.
• Identification of major challenges for deploying Artificial Intelligence on a large scale basis, such as encouraging data collection, ensuring data security and protection and digitization of systems while providing adequate protection from cyber-attacks.
• Setting up of Inter-Ministerial Artificial Intelligence Mission which would engage in bringing together relevant players and academicians to set up a repository of research for Artificial Intelligence-related activities and also coordinate among government bodies to promote Artificial Intelligence systems in India.
• Setting up of digital data banks and exchanges to empower the availability of cross-industry data and information.
• In addition, the report states that the Ministry of Commerce and Industry should create a position of Data Ombudsman to address data related issues.

The recommendation provided by the report is well thought out and are on the lines of encouraging and promoting Artificial Intelligence based systems in India.

Needless to state, but it is believed that Artificial Intelligence will become so capable in few years that it will be able to develop new technologies capable of getting patents, which can be a threat to the very basic principle of Intellectual Property Rights. Even various copyright offices across the world have already stated that they will not register any machine produced work. So the question which comes here is without human intervention who will own patents on inventions made by the Artificial Intelligence system i.e. humans or the robots?

A global survey conducted by U.K. based body called Chartered Institute of Management Accountants, amongst the European, African and Asian countries ranked India amongst the top three countries in the world implementing robotic automation in their core business processes, but, the challenge before India is to compete with countries like China and America. The Artificial Intelligence-based applications in India has been driven by private sector players, unlike in countries like America, China and South Korea where both public and private participation is given importance for Artificial Intelligence growth. Despite the initiative of Digital India, the country is still struggling with internet penetration which stands at just 29.5% of the total population, unlike China and America which are at 48% and 84% respectively. Thus, India needs to take an imperative step to boost its Artificial Intelligence research by way of the combine efforts of the IT industries, Universities and Government in order to compete with the Artificial Intelligence research community in America and China.

With the development of technology, the legal sector has changed the framework within which it operates and it becomes impossible to consider the future of the legal framework without Artificial Intelligence software’s and the technology shall eventually change the fate of the entire legal system and its participants.
